The Role

 

The position will manage the commercial aspects of any development projects at all stages from pre-contract to awarding.

Job Responsibilities

 

  • Monitoring & controlling internal processes and strategically expanding, preserving or improving procedures and standards.
  • Ensure all commercial activities are using company business tools (eg. SAP PS/ESS, Filing, ePA, templates, checklists, DOA, etc,) and are correctly implemented and utilized at all times; from feasibility until final completion and archiving.
  • Resolving contractual and commercial problems.
  • Overseeing key performance indicators of the projects, including researching / benchmarking against global project KPIs and provide solutions to better the KPIs.
  • Providing commercial direction and instruction to the project team, ensuring they understand key aspects of the contract.
  • Reporting on project performance to the senior management; including establishing cost and contracts database.
  • Assessing and managing project risks. 

Pre-contract Stage:

  • Ensure that Group standards are applied and procedures are followed throughout all of work process.
  • Ensure procurement processes are run and managed fairly and as per commercial best practices.
  • Ensure that required due diligence is undertaken so technical, commercial, financial and legal risks are identified and mitigated.
  • Ensure that costs (feasibility and procurement costs) are benchmarked and represent Value for money within competition and selection process.
  • Future dispute is avoided and managed through applicable terms.
  • Ensure that solution or service is well defined and endorsed by the competent department.
  • Obligations, liabilities, deliverables, responsibilities penalties ... etc, are fairly managed and defined during pre-contract work.
  • Ensure that local & international laws, regulations, conventions and licenses are considered.

Awarding Stage:

  • Reflect all agreed items into the contract in a contractual language.
  • Get the agreement reviewed and finalized.
  • Complete all necessary annexes.
  • Identify deferred elements with agreed timescale.
  • Get the contract signed off.
  • Filing and distribution.

Preparation and contracts management:

  • Bank guarantees, parent company guarantees, performance bond and letters of credit – review and agree content.
  • Explain and interpret contract terms and conditions to internal relevant parties – provide commercial and contractual advice to implementation team as necessary.
  • Oversee execution against agreed terms.
  • Examine contract progress and variations and take appropriate action- issue required awareness
  • Agree and authorize contract amendments, with any associated changes.
  • Engage in and handle contract disputes, EOT, loss & expense, arbitration, variation – identify possible solution and alternative options.
  • Review completion of milestones and acceptance criteria against agreed terms.
  • Close out the contract– finalization of accounts, identify start of warranty and support as applicable, return bank guarantees.
  • Ensure proper archiving of records within Group.

Job Requirements

 

  • Degree in Architecture or equivalent
  • Good subject matter knowledge across the functions of commercial, design, project management and the building process of development projects
  • Minimum 10 years of relevant experience in a professional office or construction organization, preferably with working knowledge of design and build projects
  • Familiar with local and international construction contracts, such as SIA, Redas, PSSCOC, PAM, FIDIC, JCT etc.
  • Experience in commercial, retail, residential, industrial and logistics project types across the regions
  • Promote positive team environment, work collaboratively to maximize synergies especially across the Design & Project management functions of Cost & Contracts and others within and outside Mapletree
  • Good interpersonal skills to prepare reports, negotiate and build relationships with key stakeholders, as well as people management skills
  • Planning, organizing and controlling skills with the ability to manage competing priorities and work effectively on tight deadlines
  • Continuous and incremental improvement mindset – questioning and challenging status quo to achieve a better outcome
  • Problem solving and analytical skills which will include for resolving of cost planning, contracts procurement and administration issues for various construction and design activities
  • Good leadership and people management skills
  • Dynamic, pro-active and ability to work and deliver results under pressure
